Terms of Service

Effective: September 1, 2026

Welcome to tesr ("App", "we", "us", "our"), operated by TESR Technologies Private Limited (CIN: U62011TS2026PTC220820), Hyderabad, Telangana, India. By creating an account, accessing, or using the App you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old to use the App. If you are between 13 and 17, you may use the App only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf, and with verifiable parental consent where required under India's Digital Personal Data Protection Act, 2023.

2. Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@tesr.health if you suspect unauthorized access.

3. Medical & Fitness Disclaimer

IMPORTANT. READ CAREFULLY. The App is a fitness and nutrition tracking tool only. It does NOT provide medical advice, diagnosis, treatment, personal training, physiotherapy, or any form of healthcare service.

3.1 Not Medical Advice

All content in the App, including but not limited to AI-generated training plans, suggested exercises, sets, repetitions, nutrition targets, meal suggestions, readiness ("Charge") scores, progress data, and any community content shared by other users, is for informational and tracking purposes only and does not constitute medical advice, exercise prescription, or professional fitness guidance. AI-generated plans are algorithmic outputs and may not be appropriate for every individual.

3.2 Consult a Professional

Before beginning, modifying, or intensifying any exercise or nutrition program you must consult a qualified physician, licensed healthcare provider, or certified fitness professional. This is especially important if you:

Have any pre-existing medical condition (cardiovascular, musculoskeletal, metabolic, or otherwise)
Have a history of injury, surgery, or chronic pain
Are pregnant, postpartum, or breastfeeding
Are taking medication that may affect your physical performance or safety
Have been sedentary for an extended period
Are under 18 years of age

3.3 Assumption of Risk

Exercise carries inherent risks including but not limited to musculoskeletal injury, cardiovascular events, overtraining, and in rare cases, serious injury or death. By using the App you acknowledge and voluntarily assume all such risks. You agree that you are solely responsible for:

Determining whether any exercise is appropriate for your current fitness level and health status
Using proper form, technique, and equipment
Warming up, cooling down, and resting adequately
Stopping immediately if you experience pain, dizziness, nausea, shortness of breath, or any other warning sign
Seeking immediate medical attention if any injury or adverse event occurs

3.4 No Trainer–Client Relationship

Use of the App, including AI-generated guidance, shared plans, or group challenges, does not create a trainer–client, coach–athlete, doctor–patient, or any other professional relationship between you and TESR Technologies Private Limited, its operators, or any other user of the App.

3.5 Body Metrics

The App may allow you to record body weight, body measurements, and wearable-derived signals. This data is for personal tracking only and must not be used as a substitute for professional medical or nutritional assessment. Changes in body weight or measurements can be influenced by many factors and are not by themselves indicators of health. If you have concerns, consult a qualified healthcare provider.

3.6 User-Generated Content

Plans, templates, exercise suggestions, or other content shared by users are not reviewed, verified, or endorsed by us. We make no guarantee that user-generated content is safe, accurate, or appropriate for any individual. Follow user-shared content at your own risk.

4. Limitation of Liability

4.1 Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

4.2 Limitation

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TESR TECHNOLOGIES PRIVATE LIMITED, ITS OWNERS, OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

Your use of or inability to use the App
Any injury, illness, disability, or death resulting from exercise, dietary change, or physical activity performed in connection with your use of the App
Any content obtained from the App, including AI-generated or user-generated content
Unauthorized access to or alteration of your data
Any other matter related to the App

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR INR ₹500, WHICHEVER IS GREATER.

4.3 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability is limited to the fullest extent permitted by law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or gross negligence.

5. Indemnification

You agree to indemnify, defend, and hold harmless TESR Technologies Private Limited, its owners, operators, officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

Your use of the App
Your violation of these Terms
Any injury or harm resulting from your exercise, dietary change, or physical activity
Your violation of any applicable law or third-party right

6. Acceptable Use

You agree not to:

Use the App for any unlawful purpose
Share content that is harmful, offensive, defamatory, or infringing
Attempt to gain unauthorized access to the App or other users' accounts
Interfere with or disrupt the App's infrastructure
Use automated systems (bots, scrapers) to access the App without our written permission
Impersonate another person or entity

7. Intellectual Property

All rights, title, and interest in the App (excluding user-generated content), including design, code, graphics, AI models, and trademarks, are owned by or licensed to TESR Technologies Private Limited. You may not copy, modify, distribute, or reverse-engineer any part of the App without our prior written consent.

You retain ownership of your user-generated content but grant us a worldwide, non-exclusive, royalty-free license to store, display, and transmit that content as necessary to operate the App.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App you consent to the practices described therein.

9. Subscriptions & Payments

The App may offer paid subscription tiers. Where offered, subscriptions are billed through the Apple App Store or Google Play Store, and those platforms' payment and billing terms apply. Cancellations and renewals are managed through your platform account settings. Please see our Refund & Cancellation Policy for refunds.

10. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may delete your account at any time through the App's settings. Upon termination, your right to use the App ceases immediately. Sections 3 through 5 survive termination.

11. Modifications

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App or on this website, or by other reasonable means. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law & Disputes

These Terms are governed by the laws of India, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts at Hyderabad, Telangana, India.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TESR Technologies Private Limited regarding your use of the App and supersede all prior agreements and understandings.
